Gokul agreed on a price with his builder over a cup of tea. ₹1,650 per square foot, eight months to finish, good quality materials. They shook hands. The builder’s engineer scribbled a one-page estimate and Gokul filed it away.
Four months later, right after the roof slab, the builder asked for ₹4 lakhs more. Steel prices had gone up, he said. The tiles Gokul had chosen were out of stock, and a cheaper brand would go in instead. When Gokul pointed to the eight month promise, he realised there was nothing written down to point to.
What a Strong Agreement Really Is
Specific Words Beat Friendly Words
Under the Indian Contract Act, a construction agreement is an ordinary contract, and it is only as strong as its detail. A phrase like “good quality” gives you nothing to enforce. Name the cement and steel brands, the grade of materials, the flooring and fittings, and the exact floor area. If a dispute reaches a court, the court reads what is written, not what was said over tea.
Attach the Papers That Define the Work
Both parties should be named with full legal names and addresses. The plot should be identified by survey number. The sanctioned building plan, the drawings and a room-wise specification sheet should be attached to the agreement as annexures. Anything left outside those pages is easy to argue about later.
The Clauses That Carry the Weight
Money Linked to Progress
Payments should follow finished stages such as foundation, plinth, each slab and plastering, rather than calendar dates. Keep the first advance small. Many owners also hold back a small retention amount until the defect period ends, which keeps the builder interested in finishing the last details properly.
Time With Consequences
State a start date and a completion date. Add a penalty for each week of delay, with fair exceptions for genuine causes like heavy monsoon. A deadline with no consequence is only a wish.
Changes Only in Writing
Gokul’s biggest loss came from costs that appeared without warning. A change clause fixes this. Any extra work or material swap needs a written price approved by the owner before it begins.
Defects and Disputes
Include a defect liability period during which the builder repairs problems like leaks and cracks at his own cost. Add clear termination conditions and a dispute route, usually arbitration with a named place. Without these, every disagreement becomes a long conversation.
Before You Sign
Stamp the agreement as required under your state’s rules, and have both parties sign every page with witnesses. Confirm the building permission is in place before work starts, since construction that does not match the sanctioned plan creates trouble at resale. Keep the original safely. Most importantly, let a property lawyer read the draft before you sign. The fee is small next to the cost of a disputed slab.
What Gokul Did Next
He settled the first dispute by paying ₹2 lakhs of the ₹4 lakhs demanded, after a lawyer’s notice. For the first floor he added later, he signed a nine page agreement with a milestone payment schedule and a weekly delay clause. The builder finished three weeks late and paid the penalty without argument. The second job went smoothly because the paper did its work, not because the builder had changed.
