Non-agriculturists, including salaried professionals, business owners, and companies, face significant restrictions when attempting to purchase agricultural land directly. Purchasing such land without meeting the eligibility criteria can result in the transaction being declared void meaning the buyer loses both the land and the money paid.

Who Can Legally Buy Agricultural Land in Tamil Nadu?

Practising farmers and their family members are the primary eligible buyers under existing law. Certain categories of individuals may also qualify if they can demonstrate agricultural background or intent to use the land for farming purposes.
For others including urban professionals and corporate entities direct purchase of agricultural land is either restricted or requires specific government approvals depending on the intended use.
One important distinction exists for Non-Resident Indians. NRIs of Indian origin can inherit agricultural land but cannot purchase it directly under current Foreign Exchange Management Act guidelines. This is a frequently misunderstood restriction that has caused legal complications for several buyers.

Converting Agricultural Land for Other Uses

Many buyers are interested in agricultural land not for farming but for residential or commercial development. This requires an official land use conversion a formal process where the land classification is changed from agricultural to non-agricultural through the relevant revenue and planning authorities.
Without this conversion, constructing a house or commercial building on agricultural land is not legally permissible. Banks will also not sanction home loans against unconverted agricultural land a practical limitation that catches many buyers off guard.

What Every Buyer Must Verify

Before purchasing agricultural land for sale in Tamil Nadu, buyers must check the land’s classification in revenue records, confirm the seller’s legal ownership through patta and chitta documents, verify whether any tenancy rights exist on the land, and consult a qualified property lawyer about eligibility and conversion requirements.
Agricultural land transactions in Tamil Nadu are not inherently illegal but they carry specific legal obligations that uninformed buyers routinely overlook. Getting professional guidance before signing any agreement is not optional. It is essential.
